Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and SkyKraft (“SkyKraft”, “we”, “our”, “us”). They govern your access to and use of our mobile application, website, and related services (together, the “Service”).
Please read them together with our Privacy Policy. By creating an account or using the Service, you agree to these Terms.
1. Who we are and what we do
SkyKraft operates an online marketplace that connects clients with DGCA-verified drone pilots in India. We provide the technology platform, payment rails, and pilot-verification workflow. We are not the pilot; pilots are independent professionals who deliver aerial shoots directly to clients.
2. Eligibility and accounts
- You must be at least 18 years old and capable of entering into a legally binding contract under Indian law to use the Service.
- You must provide accurate information and keep it up to date. You are responsible for all activity that happens under your account, and for keeping your credentials (including OTP codes) secure.
- You may use the Service as a client, a pilot, or both, in line with the role options offered in the app. We may require additional verification before enabling certain roles or features.
- You must notify us promptly if you suspect any unauthorised use of your account.
3. Pilot verification and licensing
- Pilots must hold a valid DGCA Remote Pilot Certificate (or the equivalent permission applicable to the flights they undertake) and any other permits, airspace clearances, or landowner consents required for a particular shoot.
- SkyKraft reviews licenses submitted by pilots but does not guarantee their continued validity or the outcome of any individual flight. Pilots are solely responsible for flying safely and lawfully.
- Verification status (including “verified” and level) is controlled by SkyKraft and may be granted, suspended, or revoked at our discretion based on the information and conduct we observe.
4. Bookings
- Bookings are subject to pilot availability and acceptance. Confirmation of a booking forms a direct contract between the client and the pilot for the shoot itself; SkyKraft is not a party to that contract.
- Each party must act in good faith — show up on time, communicate changes promptly via SkyChat, and treat the other party with professional courtesy.
- Clients are responsible for ensuring that the location of the shoot can lawfully host drone activity and for obtaining any third-party permissions required (for example, from a building society, venue, or landowner).
5. Payments, fees, and payouts
- Payments are processed by Razorpay. Clients pay SkyKraft at the time of booking; we hold the amount in escrow until the job is completed by both parties.
- SkyKraft charges a platform fee on each booking. The applicable fee is displayed in the app at checkout.
- On completion (confirmed by both client and pilot, or otherwise finalised under our cancellation/dispute rules), we release a payout to the pilot via RazorpayX net of platform fees and any applicable taxes or statutory deductions.
- Cancellations and refunds are governed by the cancellation policy displayed in the app at the time of booking. Refunds are made back to the original payment method.
- Payouts require pilots to maintain accurate, up-to-date payout details (bank account, UPI, or similar). SkyKraft is not liable for delays caused by incorrect payout details or bank downtime.
6. Your content and conduct
- You retain ownership of content you submit (photos, videos, portfolio links, reviews, chat messages). You grant SkyKraft a non-exclusive, worldwide, royalty-free licence to host, copy, display, and adapt that content to operate, promote, and improve the Service.
- You must not use the Service to break the law, harass or endanger others, spam, infringe intellectual-property rights, attempt to bypass safety or admin controls, or misrepresent your identity or qualifications.
- Reviews must reflect your genuine experience. We may remove or edit content that violates these Terms or applicable law.
7. Intellectual property
SkyKraft, the SkyKraft logo and wordmark, the app design, and the underlying software are owned by SkyKraft or its licensors. These Terms do not grant you any right to use our branding or technology beyond what is reasonably needed to use the Service.
8. Suspension and termination
- We may suspend, limit, or terminate your access to the Service at any time if you breach these Terms, if we reasonably suspect fraud, safety issues, or misuse, or if we are required to do so by law.
- You may stop using the Service at any time. You may delete your account from within the app (Profile → Settings → Delete Account). Provisions that by their nature should survive (including payment obligations, indemnities, limitations of liability, and dispute resolution) will survive termination.
9. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, or specific booking outcomes. We do not warrant the quality, safety, legality, or results of any shoot arranged through the Service — that is between the client and the pilot. You use the Service at your own risk.
10. Limitation of liability
To the maximum extent permitted by law, SkyKraft and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, goodwill, or data, arising from or related to your use of the Service. Our aggregate liability for any claim related to the Service will not exceed the greater of (a) the amount you paid to SkyKraft in the twelve months preceding the event giving rise to the claim, and (b) ₹10,000.
11. Indemnity
You agree to indemnify and hold SkyKraft, its affiliates, officers, employees, and agents harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right, including (if you are a pilot) the safe and lawful conduct of any flight.
12. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to any non-waivable rights under consumer-protection law, the courts at Mumbai, Maharashtra will have exclusive jurisdiction over any dispute arising out of or in connection with the Service or these Terms. Before starting formal proceedings, please contact us at support@skykraft.in so we can try to resolve the issue amicably.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, if the change is material, notify you in the app or by email. Continued use of the Service after the effective date means you accept the updated Terms.
